Terms and Conditions

Article 1 – Scope

These general terms and conditions of sale (hereinafter the “Terms and Conditions”) apply without restriction or reservation to all sales concluded between Océane Buret (hereinafter referred to as “Les Objoies”), a micro-enterprise exempt from registration with the Trade and Companies Register (RCS) and the Trade Directory (RM), registered under SIREN no. 751092057 (VAT not applicable pursuant to Article 293 B of the French General Tax Code – CGI), and consumers wishing to make a purchase in mainland France on the website www.oceane-buret.com (hereinafter the “Site”).

These Terms and Conditions are accessible at any time on the Site and shall prevail, where applicable, over any other version or any conflicting document. Les Objoies reserves the right to modify its Terms and Conditions at any time without prior notice to the Customer. The amended Terms and Conditions are enforceable against the Customer from, and for the entire duration of, their online publication, for products ordered after they are posted online.

Each purchase on the Site is subject to all provisions of the Terms and Conditions in force on the date the order is placed. The Customer may only validate an order after having read and accepted these Terms and Conditions by checking the box provided for that purpose. By validating the order and checking the relevant box, Les Objoies considers that the Customer has duly read and unreservedly accepts the Terms and Conditions. The terms applicable and enforceable against the Customer are those in force at the time the Customer effectively validates the order recorded on the Site. By accepting these Terms and Conditions at the time of ordering, the Customer declares having the legal capacity to enter into a contract within the meaning of Articles 1123 et seq. of the French Civil Code and confirms being a non-trader natural person of legal age acting for personal needs. These Terms and Conditions apply to the exclusion of all other conditions, including those applicable to sales made through other distribution and marketing channels.

Article 2 – Purpose
The purpose of these terms is to define the framework for online sales of decoration items, furniture, textiles, tableware, and any other product sold on the Site, and the rights and obligations arising therefrom. These Terms and Conditions are intended to govern:

  • The organization of the legal relationship between Les Objoies (represented in the Terms and Conditions by Océane BURET) and the Customer.

  • The terms of sale between Les Objoies and the Customer (ordering, delivery, etc.).

Article 3 – Ordering procedure and terms
3.1 – Customer identification
To place an order, the Customer must log in to the Site. The Site is accessible 24/7, subject to service-level incidents. For a first order, the Customer must create an account via the “My Account” section and fill in the required information in the dedicated form. The Customer expressly undertakes not to use false information or information belonging to third parties. Registration on the Les Objoies Site becomes effective once the Customer clicks the “Confirm” button. For subsequent orders, the Customer can access their account by entering their username and password. The Customer is fully responsible for the confidentiality of their username and password.

3.2 – Placing the order
The Customer must follow the steps specified on the Site. Any order placed will be confirmed by an email sent by Les Objoies to the email address provided by the Customer, containing a summary of the order, the delivery location, and the payment method. This information will also be available on the Site in the “My Account” section. If this confirmation email is not received, the Customer must check their spam/junk folders or other anti-spam software.

Before final validation of the order, the Customer may correct any errors in the entered data. The Customer may only validate the order after having read and accepted these Terms and Conditions by checking the box provided for that purpose. Any order validated by the Customer is considered effective by Les Objoies only after payment is confirmed.

The data provided by the Customer and recorded by Les Objoies when the order is placed constitute proof of the transactions between the Customer and Les Objoies. Information relating to the order is processed electronically, for which Les Objoies is the data controller, in accordance with Article 13 of these Terms and Conditions.

3.3 – Cancellation
Once the order is validated, it is binding on the Customer, subject to the implementation of Article 11 “Right of withdrawal”.

However, as an exceptional measure, Les Objoies offers the Customer the option to cancel their order within forty-eight (48) hours after validation. This option can only apply to the entire order (not partially) and will only be accepted if and only if no goods have yet left the Les Objoies warehouse. The cancellation request must be made by email to oceaneburet@gmail.com, indicating in the subject line the Customer’s name and order number. As this is a supra-legal option, Les Objoies remains the sole judge of whether to accept or refuse the cancellation request. The order will be refunded within a maximum of fourteen (14) days.

3.4 – Order tracking
Upon receipt of the email sent by Les Objoies, the Customer can track the order online in the “Order Tracking” section.

Article 4 – Prices
Pursuant to Article 293 B of the CGI, VAT is not applicable to products sold by Les Objoies. Prices shown on the Site are expressed in euros and are inclusive of all taxes (TTC), including any applicable eco-contributions on the order date. Les Objoies reserves the right to modify prices at any time before final validation of the order, in particular in the event of increased costs or manifest error. Products are invoiced at the rate in effect on the Site at the time the Customer finally validates the order.

Product prices do not include delivery charges. These charges are calculated and added to the total order amount after the cart is validated. The Customer is informed of the delivery charges before final validation of the order.

Les Objoies reserves the right to change its prices at any time, without notice, it being understood that the price displayed at the time of the Customer’s order will not be altered.

Article 5 – Payment terms
5.1 – Payment methods
Products displayed on the Site must be paid for in full at the time of ordering, in a single payment. As such, no discount or late-payment penalty applies. Amounts paid in advance are neither deposits nor down payments.

The Customer has the following payment method:

  • PayPal: Les Objoies offers secure payment via PayPal. By choosing this method, the Customer will be invited to log in to their PayPal account to pay for the order.

5.2 – Anti-fraud measures
To limit fraud, Les Objoies reserves the right, as a condition of sale, to request proof of the Customer’s identity, place of residence, and payment method. In such cases, order processing will begin upon receipt of these documents. Les Objoies reserves the right to cancel the order in the absence of such documents or if the documents are deemed non-compliant. Les Objoies also reserves the right to refuse any order in the event of a dispute relating to payment for a previous order.

5.3 – Payment incident
Les Objoies is not obliged to deliver products ordered by the Customer if the price has not been paid in full under the conditions indicated above. Upon charging the order, in the event of incomplete, irregular, or non-existent payment for any reason, or in the event of any payment incident, Les Objoies reserves the right to suspend or cancel delivery of current orders.

In the event of non-payment for any reason, a flat amicable fee of fifteen euros (€15) will be charged by Les Objoies in addition to the invoice amount, plus any debit fees charged by Les Objoies’ bank if amicable recovery remains unsuccessful within ten (10) days from the date the first recovery letter is sent, whether by registered or ordinary mail. Collection will then proceed through legal channels. Any collection costs charged by the collection agency acting for Les Objoies directly to the Customer are independent of the flat amicable fee. In the event of non-payment following a formal notice that remains without effect, Les Objoies retains full ownership of the ordered products until full payment and may bring a recovery action before the competent court.

Article 6 – Product availability
Product offers presented on the Site are valid while stocks last. Before any purchase, the Customer is informed of product availability. The Customer acknowledges and accepts that Les Objoies will make every effort to process and fulfill all validated orders.

If, after order confirmation by Les Objoies, products become wholly or partly unavailable, Les Objoies will inform the Customer by email of such unavailability pursuant to Article L 121-20-3 of the French Consumer Code. In this context, the Customer may:

  • Receive from Les Objoies a product of equivalent quality and price; or

  • Obtain a refund of the order within fourteen (14) days following payment for the product.

Article 7 – Invoicing
The invoice sent to the Customer reflects the information provided in the Customer’s account. The buyer may modify this data when placing any new order on the Site.

Article 8 – Delivery & Customs duties and import taxes (orders delivered outside the European Union)
8.1 – Delivery methods
Products may be delivered worldwide. Delivery is made to the address indicated by the Customer when placing the order.
For deliveries to countries outside the European Union, additional charges such as customs duties, import taxes, tariffs and carrier handling/clearance fees may apply. These charges are assessed by the destination country’s customs authorities and are payable by the Customer. To expedite delivery, the carrier or customs may contact the Customer directly to arrange payment before release or at delivery. Any delays caused by customs clearance or the Customer’s non-payment do not give rise to a refund or compensation. If the Customer refuses to pay the amounts due or refuses the parcel, any return shipping, customs or handling fees charged to Les Objoies may be deducted from the refund of the order, where applicable.

At the time of ordering, the delivery method is specified to the Customer. Les Objoies distinguishes delivery methods depending on the products ordered. The order may therefore be delivered in several parcels and on different dates, which the Customer accepts.

8.2 – Checks before validating the order
Before ordering, the Customer must ensure that each product ordered can be delivered without difficulty and verify that the dimensions of the parcels and products specified on the product page fit the constraints of their home (elevators, stairs, hallways, front doors, destination room, etc.). The Customer must take all measures necessary for smooth delivery.

Any difficulty encountered during delivery for which the Customer is solely responsible will result in the Customer bearing the costs of a new delivery.

8.3 – Delivery times
Les Objoies undertakes to inform the Customer of delivery times. Indicated delivery times are calculated in business days (excluding Sundays and public holidays). Delivery times run from the date the Customer receives an order confirmation email.

In the event of a delivery issue, Les Objoies will use best efforts to inform the Customer of any potential delay.

8.4 – Best practices upon delivery
Before signing the delivery slip, the Customer must:

  • Check the apparent condition of the parcel(s).

  • Check the condition of the products inside the parcel(s).

  • Check that the products comply with the delivery slip and with the goods ordered.

It is the Customer’s responsibility to carry out all necessary checks to assess product conformity upon delivery. When delivery is made by a courier, this verification is deemed to have been carried out once the Customer signs the delivery slip. In case of anomalies noted upon delivery, the Customer must make the necessary, detailed, legible, and as precise as possible reservations (breakage, damage, non-conformity, wrong product, different size, missing items, etc.) and refuse delivery of the parcel(s), stating the reasons for refusal on the delivery slip. The mention “subject to unpacking” will be refused.

Article 9 – Retention of title and transfer of risk
Les Objoies retains title to the products sold until full payment of the price (principal and ancillary). Failure to pay any installment may result in Les Objoies reclaiming the products. These provisions do not prevent the transfer to the Customer, upon receipt, of the risks of loss and deterioration of the purchased products and of any damage they may cause.

Article 10 – Product information
Les Objoies publishes with the utmost rigor information concerning the essential characteristics of the products and undertakes to provide descriptions in the “Description” section of each product page.

Differences may exist between delivered products and those shown on the Site. Such differences, insofar as they do not concern the essential characteristics of the products and do not affect their quality, shall not justify cancelling the order or refusing delivery.

Due to technical contingencies inherent in photography and internet browsing software and/or display monitors, color rendering on the Site is indicative and can in no case be guaranteed to match the actual colors of the products shown. Sometimes significant color variations may occur and cannot be cited against Les Objoies. Moreover, unintentional errors or omissions that may remain despite our care and careful checks shall not incur our liability.

Article 11 – Right of withdrawal
11.1 – Withdrawal terms
In accordance with Article L 121-21 of the French Consumer Code, the Customer has a period of fourteen (14) clear days from receipt or collection of the products to return them to Les Objoies for exchange or refund. Return shipping costs are borne exclusively by the Customer.

11.2 – Product return procedure
The Customer must exercise the right of withdrawal by contacting customer service by email at oceaneburet@gmail.com. Les Objoies undertakes to contact the Customer within seventy-two (72) hours to detail the product return procedure.

The Customer must place all products in the parcel(s) and carefully prepare the return package(s). Products must be returned in their original packaging and in perfect condition. Returns will be accepted only if the return procedure is followed by the Customer. The Customer may not exercise the right of withdrawal if returned products are unsuitable for resale due, for example, to obvious deterioration.

In the event of a return by a Customer who has exercised the right of withdrawal under this Article, the Customer assumes the transport risks. In the case of non-conforming deliveries, the Customer must confirm reservations regarding delivered products no later than two (2) days after the date of receipt. Such reservations must be sent by registered letter with acknowledgment of receipt to Les Objoies, 18, rue de l’Atlas 75019 Paris, and include at least two photos and a copy of the carrier’s delivery slip showing the reservations. After this period, any request will be rejected by Les Objoies and Les Objoies’ liability cannot be incurred.

Under the legal warranty of conformity, accepted claims will result in bringing the product into conformity or exchanging the defective or non-conforming product, or refunding it if the product is out of stock. Any product damaged by the Customer will not be refunded.

No unsolicited return, without Les Objoies’ prior agreement, will be accepted.

In the absence of specific reservations made by the Customer, delivery will be presumed compliant.

11.3 – Refunds
When the right of withdrawal is exercised, Les Objoies undertakes to refund the Customer within fourteen (14) days from the date the right was exercised, after completing all product checks. The refund method will correspond to the payment method used by the Customer. Any product damaged by the Customer will not be refunded.

Article 12 – Disputes and liability

The Customer must verify the completeness and accuracy of the information provided to Les Objoies when ordering, particularly the delivery address. The Customer is responsible for the information provided during registration and ordering. Les Objoies cannot be held liable for any entry errors that could cause delivery errors. If the delivery address proves erroneous or if the Customer decides to change the delivery address after the products have been dispatched by Les Objoies, the costs of the new delivery shall be borne by the Customer. The choice and purchase of products are the sole responsibility of the Customer. Consequently, the total or partial impossibility of using the products, notably due to product incompatibility, shall not give rise to any compensation, refund, or liability of Les Objoies, except in cases involving the exercise of the right of withdrawal provided by the Consumer Code.

Events of force majeure or unforeseen circumstances that are irresistible, unforeseeable, and beyond the parties’ control—particularly nationwide carrier strikes or natural disasters such as floods or fires—are considered exculpatory grounds for liability.

Article 13 – Data protection
Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), Les Objoies collects the Customer’s personal data for the purposes of processing the order, issuing invoices, and identifying the Customer. “Personal data” refers to information concerning the Customer as a natural person, voluntarily communicated by the Customer. Personal data thus includes identifying information (such as names, first names, contact details, etc.). Les Objoies protects the Customer’s privacy in compliance with applicable law.

In accordance with French Law No. 78-17 of 6 January 1978 on Information Technology, Data Files and Civil Liberties, as amended by Law No. 2004-801 of 6 August 2004, and the GDPR, the Customer has rights of access, rectification, portability, and erasure of personal data concerning them, as well as the right to object to processing. To exercise these rights, the Customer may send a letter to: Les Objoies, 14 rue Lénine 93170 Bagnolet, or an email to oceaneburet@gmail.com.

Additionally, information provided on the Site allows Les Objoies, with the Customer’s consent, to send newsletters about current promotions, events organized by Les Objoies, and news about Les Objoies. The Customer may decline such newsletters either by not giving consent when registering and/or validating an order, or by objecting free of charge to the use of their contact details for commercial offers. The Customer may submit a request either by clicking the unsubscribe link in each email or in writing to the address indicated above.

Article 14 – Intellectual property
Elements published on the Les Objoies Site—including, in particular, logos, registered trademarks, texts, photographs, images, drawings, models, or paintings—constitute works protected by intellectual property rights or personality rights. Any reproduction or representation, in whole or in part, of this Site is therefore prohibited without the prior express consent of the holders of these rights and would constitute infringement punishable under the provisions of the French Intellectual Property Code and/or a tort giving rise to civil liability of the infringers. Furthermore, the Customer may only access the database content and any other elements of the Site and display them for non-commercial, private use.

Article 15 – User liability
Browsing the website www.oceane-buret.com is the sole responsibility of users. Les Objoies cannot be held liable for breakdowns, errors, or computer viruses that may hinder continuous access to its site, or for malfunctions in users’ computer installations that may be observed following access to the Site. Les Objoies shall not be liable for direct or indirect damages that may be linked to the use of, access to, or downloading of items stored on the Site (images, texts, video files, etc.).

Article 16 – Use of cookies
A cookie is a small file containing textual information saved on your hard drive when you visit a website. Our Site uses cookies that we can access when you return to our Site. These cookies allow us to record information about the pages you view on our Site. They help us understand your browsing on the Site and allow us to save your preferences for future visits in order to improve the services we can offer. You may, if you wish, block cookies by changing your internet browser preferences.

Article 17 – Severability and no waiver
If any provision of these Terms and Conditions becomes null, unenforceable, void, illegal, or inapplicable by virtue of a law, regulation, or final decision of a competent court, such circumstance shall not affect the validity, legality, or enforceability of the other provisions, which shall remain in force. The Customer remains bound to perform contractual obligations and may not claim any exemption from liability on this basis.

The failure of either Party to require the application of any provision of these Terms and Conditions, whether permanently or temporarily, shall not be construed as a waiver of that Party’s rights arising from said provision.

Article 18 – Language and Governing law
These Terms and Conditions are drafted in French. If translated into one or more languages, only the French text shall prevail in the event of a dispute. These Terms and Conditions are governed by French law.

The parties shall first seek an amicable resolution before any litigation. Failing an amicable agreement, any dispute relating to the formation, performance, interpretation, or termination of these Terms and Conditions, even in the event of third-party claims or multiple defendants, shall fall under the exclusive jurisdiction of the French courts.

If a dispute cannot be resolved amicably, any legal action shall, subject to Article 48 of the French Code of Civil Procedure, fall under the exclusive jurisdiction of the competent courts within the jurisdiction of Les Objoies, notwithstanding multiple defendants or third-party claims, including emergency proceedings, protective measures by motion or petition.

Article 19 – Miscellaneous
19.1 Evidence
By express agreement between Les Objoies and the Customer, emails shall be deemed proof between the Parties, as shall the automatic recording systems used on the Site, particularly as to the nature and date of the order. The Customer may, in accordance with common-law rules, access the electronic contract concluded with Les Objoies. To do so, the Customer shall contact Les Objoies by email and provide all necessary information, including the order number and contact details.

19.2 Headings
In the event of any difficulty interpreting the headings of articles and chapters and any of the clauses, the headings shall be deemed non-existent.

19.3 Entire agreement
These Terms and Conditions and the order summary sent to the Customer form a contractual whole and constitute the entirety of the contractual relationship between the Parties.
